Guide to Colorado's Legal Cannabis

Amendment 64, which enacted officially on December 10th, 2012, legalized the possession, use, sale, production, and manufacturing of cannabis and cannabis infused products under certain guidelines for anyone over 21. On January 1st, 2014, retail cannabis stores were officially allowed to open to the public. ### How much can I carry around and where do I smoke?

Anyone, citizen of Colorado or not, may possess up to an ounce of cannabis. In order to toke up legally, you must be within a private residence that the owner has allowed the use of cannabis. Any public use of cannabis is prohibited. There are various other caveats on use, such as smoking inside any place licensed to deal with children (SB-283 Section 19), or restrictions already in place banning smoking in indoor businesses (Colorado Clean Indoor Air Act 2006). ### How much can I buy? Can I take it out of CO?

Citizens of Colorado may purchase an ounce of cannabis at a time, while out-of-state stoners will have to settle for a quarter ounce (1/4 oz) at a time. However, you can make multiple purchases a day, as long as you don't exceed the possession limit. The purchases are not tracked by the retail cannabis stores, explicitly outlined in Amendment 64: > "The department shall not require a consumer to provide a retail marijuana store with personal information other than government-issued identification to determine the consumer's age, and a retail marijuana store shall not be required to acquire and record personal information about consumers other than information typically acquired in a financial transaction conducted at a retail liquor store."

All cannabis must also stay within Colorado. No cannabis may cross state lines. Border patrol has allegedly incrased their scrutiny for cannabis, as well as the TSA (when they recently revealed they'd loosened up to medical marijuana patients). ### Can I drive high? Can I keep my kush in the car?

You may not drive high. If you are suspected of driving intoxicated, you may be subject to a sobriety and blood test under the officer's discretion. If the blood test reveals THC at concentrations of 5 nanograms per liter or above, you'll be arrested for DUID. Cannabis must be kept in a sealed container, preferably in your trunk. There is a $50 fine for an open cannabis container in a car, it's treated like an open container of alcohol. ### How much is the tax?

All recreational cannabis purchases will be taxed accordingly. There's a state tax(2.9%), special state sales and excise taxes(25%), as well as extra local and excise taxes. Denver, for example, has a 3.5% tax rate. This would bring the tax to 31.4%. ### Where can I buy cannabis?

You can purchase cannabis only from MMC(Medical Marijuana Center) licensed retail outlets. It is illegal to sell cannabis without a license. There are various recreational cannabis stores that are located adjacent to, or in the same location as a medical marijuana dispensary.
